RULES OF PROCEDURE
PREAMBLE
Article 1 – Purpose and scope of the rules
These rules apply to all participants in a training program organized by the organization. A copy is given to each trainee. When the training takes place on the company’s site, the general and specific safety instructions applicable are those of the training organization.
The regulations define the health and safety rules, the general and permanent rules relating to discipline as well as the nature and scale of sanctions that can be taken against trainees who contravene them and the procedural guarantees applicable when a sanction is envisaged.
All trainees must respect the terms of these rules throughout the training course.
Article 2 – Information required from the trainee
According to the provisions of Article L6353.9 of the Labor Code, amended by Law 2018-771 of September 05, 2018.
The information requested, in any form whatsoever, by a training organization from the applicant for an action as defined in Article L6313-1 of the Labor Code, to a trainee can only have as a purpose to assess his ability to follow the training action, whether it is requested, proposed or continued. This information must have a direct and necessary link with the training activity, and it must be answered in good faith.
SECTION 1: HEALTH AND SAFETY RULES
Article 3 – General principles
The prevention of risks of accidents and illnesses is imperative and requires everyone to respect
- the applicable health and safety regulations on the training premises;
- any instructions imposed by the training organization, particularly with regard to the use of equipment provided.
Each trainee must ensure his or her own personal safety and that of others by respecting the general and specific health and safety instructions applicable to his or her training.
If he/she notices a malfunction of the security system, he/she immediately informs the person in charge of the training organization.
Failure to comply with these instructions may result in disciplinary action.
Article 4 – Fire instructions
In accordance with articles R. 4227-28 et seq. of the French Labour Code, fire instructions and in particular a map showing the location of fire extinguishers and emergency exits are posted on the premises of the training organization.
The trainee must take note of them.
In the event of an alarm, the trainee must cease all training activities and follow the instructions of the authorized representative of the training organization or the emergency services in a calm manner.
Any trainee who witnesses the beginning of a fire must immediately call the emergency services by dialing 18 from a landline or 112 from a cell phone and alert a representative of the training organization.
Article 5 – Alcoholic beverages and drugs
The introduction or consumption of drugs or alcoholic beverages on the premises is strictly forbidden. It is forbidden for trainees to enter or remain in the training organization in a state of intoxication or under the influence of drugs.
Trainees will have access to the non-alcoholic beverage dispensing stations during breaks.
Article 6 – No smoking
In accordance with the decree n°2006-1386 of November 15, 2006, it is formally forbidden to smoke in all closed and covered places which receive the public or which constitute places of work. This prohibition applies in particular to classrooms where training courses are held as well as in all premises where this prohibition is in force.
Article 7 – Prohibition on eating in training rooms
It is forbidden to take meals in the training rooms or in the kitchen reserved for the training organization’s salaried staff.
It is forbidden to eat in the common areas (reception hall, corridors, landings…)
Article 8 – Accident
The trainee who is the victim of an accident – occurring during the training or during the journey between the training place and his/her home or workplace – or the witness of this accident immediately informs the person in charge of the training organization.
In accordance with article R. 6342-3 of the French Labour Code, the head of the training organization shall take the appropriate steps to obtain medical care and file a declaration with the competent social security fund.
SECTION 2: GENERAL DISCIPLINE
Article 9 – Formality attached to the follow-up of the training
The trainees are required to follow all the sequences programmed by the training provider, with assiduity and punctuality, and without interruption. Attendance sheets are signed by the trainees, by half-day, and countersigned by the instructor.
At the end of the training course, the trainee is given a certificate of completion of the training and a certificate of attendance to be sent, as the case may be, to his/her employer/administration or to the organization that finances the course.
Article 10 – Training schedules
Trainees must comply with the schedules set and communicated in advance by the training organization. Failure to comply with these schedules may result in sanctions.
Except in exceptional circumstances, the trainees cannot be absent during the training hours.
Our training courses take place on working days from 9:30 am to 12:30 pm in the morning and from 1:30 pm to 6 pm in the afternoon.
Article 11 – Absences, lateness or early departure
Any foreseeable absence of the trainee, whether or not he/she is also the client, and whatever the cause, must be announced and declared in writing, on a blank sheet of paper or by e-mail. Depending on the context, the provisions of the General Terms and Conditions of Sale of the training organization, of the Training Agreement or Contract, of the estimate, and more generally of the article L6354-1 will apply.
Article L6354-1: In the event of total or partial non-performance of a training service, the service provider organization shall reimburse the co-contractor for any sums unduly received as a result. In case of cancellation by the trainee and/or the client, there may be separate invoicing for compensation.
All absences are subject to the written authorization of the head of the establishment or his representatives.
In the event of illness, the student must notify the school from the first half-day of absence. A medical certificate must be presented within 48 hours.
In the event of a work or commuting accident, the circumstances must be communicated in writing within 48 hours.
The training organization immediately informs the financer (employer, administration, etc.) of this event.
Any event that is not justified by specific circumstances constitutes a misconduct liable to disciplinary sanctions.
Article 12 – Access to training premises
Unless expressly authorized by the training organization, the trainee may not:
- enter or remain in the training premises for any purpose other than training;
- introduce, have introduced or facilitate the introduction of persons not belonging to the organization;
- sell goods or services on the premises.
Article 13 – Dress code
The trainee is invited to come to the organization in proper dress.
Article 14 – Behavior
The trainees commit themselves to observing the behavior in use in any community as well as the rules fixed by the trainer.
They commit themselves to respect the duty of reserve and discretion allowing the free expression of the group.
They must be as correct and courteous as possible with each other and with the personnel they are called upon to work with.
Article 15 – Use of equipment
Unless specifically authorized by the training organization, the use of training equipment is done on the training premises and is exclusively reserved for the training activity. The use of the material for personal purposes is forbidden.
The trainee is required to keep the equipment entrusted to him/her for training in good condition. He/she must use it in accordance with its purpose and according to the rules issued by the trainer.
The trainee must immediately inform the trainer of any anomaly with the equipment.
SECTION 3: DISCIPLINE – SANCTIONS – PROCEDURE
Any failure by the trainee to comply with any of the provisions of these internal regulations may be subject to a sanction.
Any measure, other than verbal observations, taken by the head of the training organization or his or her representative, following an action taken by the trainee which he or she considers to be at fault, whether or not this measure is likely to immediately affect the presence of the trainee in the course or to jeopardize the continuity of the training he or she is receiving, constitutes a sanction within the meaning of article R 6352-3 of the French Labour Code.
Depending on the seriousness of the breach, the sanction may consist of
- Either a warning ;
- A reprimand or a call to order
- Or a permanent exclusion measure (please note that in the agreement signed by the organization with the State or the Region, specific provisions are defined in the event of the application of the above sanctions).
Fines or other financial penalties are prohibited.
The person in charge of the training organization must inform the organization of the sanction taken:
- The employer, when the trainee is an employee benefiting from a training course within the framework of the company training plan;
- The employer and the joint body that paid for the training, if the trainee is an employee on a training course as part of a training leave.
SECTION 4: COMPLAINTS PROCEDURE
The various parties involved in the training action (clients, beneficiaries, trainers) have the possibility at any time to make a complaint about the training offers and services of the Paymerix training organization or to report to the same organization any incident or malfunction noted during the performance of the service.
Within the framework of the training organization’s procedure for managing undesirable events, stakeholders can make their complaint:
- Orally by telephone or face-to-face with the training assistant or the manager in charge of the training (in both cases, the complaint will be recorded in an adverse event declaration form).

Each complaint will be studied and a response will be provided to the reporter as soon as possible.
